PREAMBLE
These General Terms and Conditions of Sale (hereinafter "GTC") are concluded between: On one hand, the company MSA STORE [SASU], registered with the PARIS RCS under number 993 088 343, whose registered office is located at 60 rue François 1er 75008 Paris, hereinafter referred to as the "Seller" or "Hollys Men." And on the other hand, any non-commercial natural person wishing to make a purchase via the website hollysmen.com, hereinafter referred to as the "Client."
ARTICLE 1 - Scope
These GTC govern the sale of fashion products, watches, leather goods, and accessories (hereinafter "The Products") by the Seller to the Client. The Client declares to have read and accepted these GTC by checking the box provided for this purpose before implementing the online ordering procedure. Validation of the order constitutes acceptance without restriction or reservation of these GTC, including the additional Shipping and Return Policies.
ARTICLE 2 - Products and Availability
2.1 Characteristics: The essential characteristics of the Products and their respective prices are made available to the Client on the site. The Seller strives to present the Products with the greatest possible accuracy (descriptions, photographs). However, minor variations (notably in color or leather texture) may exist and shall not engage the Seller's liability. 2.2 Availability: Product offers are valid as long as they are visible on the site, within the limit of available stocks from our suppliers and logistical partners. In case of unavailability after placing an order, the Seller will inform the Client by email. The order will be automatically canceled, and the Client will be fully refunded.
ARTICLE 3 - Prices and Customs Duties Management
Prices are indicated in Euros (€) including all taxes (TTC) for the European Union, taking into account the VAT applicable on the day of the order. 3.1 EU Prices and Shipping Costs: Prices for the EU zone include the flat cost of Standard logistics. Indicated prices do not include Express delivery fees, which are invoiced additionally. 3.2 Prices and International Customs (DDP): For markets located outside the European Union, notably the United States and Canada, displayed prices are necessarily adjusted. This price difference includes:

The cost of Standard transport logistics.

Customs duties, import taxes (DDP - Delivered Duty Paid), and administrative fees related to importation. The price displayed for the USA and Canada is the final and guaranteed price. The Client will have no additional costs (customs, taxes) to pay upon receipt. For more details, please refer to our Shipping Policy.
ARTICLE 4 - Ordering
The order is carried out according to the following steps:

The Client selects Products and adds them to their cart.

They validate the cart after checking its content.

They identify themselves (account creation or login) and provide the delivery address.

They choose the delivery method.

They accept the GTC and validate the payment. Any order constitutes acceptance of the prices and descriptions of the Products available for sale. The Seller will acknowledge receipt of the order by sending an automatic email. Once validated, the client has access to a tracking service in the "Track My Order" section.
ARTICLE 5 - Payment Conditions
Payment is due immediately upon ordering. The Client may pay via: Credit Card (Visa, MasterCard, Amex) or [Other means: PayPal, Apple Pay]. Transactions are secured by the SSL protocol via our payment provider Shopify Payments. The Seller never has access to the Client's bank details.
ARTICLE 6 - Delivery
6.1 Deadlines and Preparation: Products are shipped by our logistical partners within 1 to 3 business days following payment validation. 6.2 Transit Times and Fees (DDP): Delivery times are calculated from the shipment of the order as follows:

6.3 Delivery Terms, Risks, and DDP: Delivery is made to the address indicated by the Client. For the USA and Canada, Hollys Men handles the declaration and payment of customs duties (DDP). Packages are insured only against loss by the carrier. 6.4 Non-Delivery and Loss: If a package is declared lost, the Seller will file a claim. Upon approval, the Seller agrees to reship or refund. Insurance does not cover damage to goods or transport delays. 6.5 Force Majeure: Delivery may be affected by natural disasters, pandemics, or government restrictions beyond the Seller's control.
ARTICLE 6 BIS - Unclaimed Packages and Erroneous Addresses
6 Bis.1 Unclaimed Packages: If a package is returned to the sender, the buyer covers all return costs and any return customs fees. 6 Bis.2 Incorrect Addresses: The same provisions apply if a package is returned due to incorrect or incomplete information provided by the Client.
ARTICLE 7 - Transfer of Ownership and Risks
7.1 Ownership: Ownership of the Products is transferred only after full payment of the price. 7.2 Risks: Risk of loss or damage is transferred when the Client (or a third party designated by them) takes physical possession of the Products.
ARTICLE 8 - Right of Withdrawal
In accordance with Article L.221-18 of the Consumer Code, the Client has 14 days from receipt to exercise their right of withdrawal. 8.1 Return Terms: Notification must be sent to contact@hollysmen.com. Products must be returned in original, brand-new condition, unworn, with tags and original packaging. 8.2 Fees and Refund: Return shipping costs are the Client's responsibility. Refunds are processed within 14 days of notification (subject to recovery of the Product). 8.3 Return Carrier and Customs (Outside EU):

EU Returns: Client's responsibility.

Logistical Requirement: The Client must use a private courier (UPS, DHL, or FedEx).

Package Refusal: Hollys Men reserves the right to refuse packages sent via local postal services (e.g., USPS, La Poste) if tracking/speed is insufficient.

Non-EU Returns (USA/Canada): Private carrier mandatory. The Client is responsible for any customs fees charged to Hollys Men upon return. These will be deducted from the final refund.
ARTICLE 9 - Legal Warranties
The Seller guarantees the conformity of the goods. The Client benefits from:

Legal Warranty of Conformity: 2 years to act (repair or replacement).

Warranty against Hidden Defects: Resolution of sale or price reduction.
ARTICLE 10 - Liability
The Seller's liability is not engaged in cases of: non-compliance with the legislation of the delivery country, misuse, professional use, or normal wear and tear. Liability is limited to the amount of the order.
ARTICLE 11 - Personal Data
The Seller collects data for order processing and CRM. In accordance with GDPR, the Client has the right to access, rectify, erase, and port their data via contact@hollysmen.com.
ARTICLE 12 - Intellectual Property
All elements of the hollysmen.com site are the exclusive intellectual property of the Seller. Any reproduction or use is strictly prohibited.
ARTICLE 13 - Applicable Law and Mediation
13.1 Applicable Law: These GTC are subject to French law. 13.2 Mediation: In case of dispute, the Client should first contact Customer Service. If unresolved, the dispute may be submitted to the mediator: CM2C (https://www.cm2c.net/). Failing an amicable agreement, the dispute will be brought before the competent courts of Paris.
